Terms and Conditions
The following terms and conditions are the terms on which James Duffield Electrical Services Ltd. sells products and/or provides electrical services, apart from any further or altered conditions specified in individual estimates or quotations.

1. Price and payment
1.1. The price for the goods or services ("the price") shall be as stated on the quotation or estimate provided by James Duffield Electrical Services Ltd., or such other price as the parties may agree in writing or orally.
1.2. All works are undertaken during regular working hours (Monday to Friday, 9am-5pm). Out-of-hours, weekend, or public holiday work will incur an additional surcharge, unless otherwise agreed in writing.
1.3. All payments must be made within 15 calendar days of the invoice date unless agreed otherwise in writing.
1.4. Interest and compensation may be charged on overdue invoices under the Late Payment of Commercial Debts (Interest) Act 1998, currently at 8% above the Bank of England base rate, together with a fixed debt recovery fee (£40-£100 depending on invoice value).
1.5. Preferred payment methods are BACS transfer (or cash/cheques only by prior agreement).
1.6. Deposits may be required for larger projects or to cover advance material costs. Deposit terms will be stated in the quotation and are non-refundable once goods are ordered.
1.7. Any works required but not included in the agreed estimate or quotation will be charged at our standard hourly rate plus materials, unless otherwise agreed in writing.
1.8. If materials are supplied by the customer, they must be on site, correct, and available for use at the required time. Delays caused by missing or unsuitable materials not supplied by James Duffield Electrical Services Ltd. will be charged at the standard hourly labour rate.
2. Works
2.1. All works will conform to the specification set out in the order for works, as accepted by the customer, or as otherwise expressly agreed in writing or orally.
2.2. All quotations and estimates are valid for 30 days from the date of issue.
2.3. Verbal or written estimates are provided in good faith but are not binding. Final costs may vary if unforeseen works are identified once work has commenced.
2.4. Variations to the agreed scope of works must be confirmed in writing (email is acceptable). Additional works will be charged at the standard hourly rate and/or agreed price.
3. Delivery, cancellation and access
3.1. The client shall be deemed to have accepted the goods and services upon completion of the installation work.
3.2. Any cancellation of an order must be made in writing. The customer will be liable for any materials ordered and any labour carried out up to the time of cancellation.
3.3. If less than 48 hours' notice of cancellation or postponement is given, a call-out or administration fee may be charged in addition to the costs described in 3.2.
3.4. If our electrician is unable to gain access to the property at the agreed time, a call-out charge may be applied.
3.5. The customer is responsible for ensuring safe, clear, and reasonable access to the property. This includes informing James Duffield Electrical Services Ltd. of any concealed services (water, gas, electrical, data, asbestos, etc.).
3.6. James Duffield Electrical Services Ltd. will take reasonable care, but accepts no liability for incidental damage to decoration, carpets, plasterwork, or other finishes when carrying out work. Redecoration, plastering, or flooring reinstatement is not included unless specifically agreed in writing.
4. Title to goods
4.1. James Duffield Electrical Services Ltd. warrants that it has good title to the goods and will transfer title in the goods to the customer once full payment is received.
4.2. Notwithstanding delivery, title in the goods shall not pass to the customer until James Duffield Electrical Services Ltd. has been paid in full.
4.3. In cases of non-payment, James Duffield Electrical Services Ltd. reserves the right to remove goods supplied or installed, where it is safe and lawful to do so.
4.4. Any unwanted items removed from the customer's property by James Duffield Electrical Services Ltd. as debris or waste shall become the property of James Duffield Electrical Services Ltd. unless otherwise agreed.
5. Guarantee and warranty
5.1. All installation work carried out by James Duffield Electrical Services Ltd. is covered by a 12-month workmanship guarantee from the invoice date, unless otherwise stated.
5.2. Where goods are supplied by James Duffield Electrical Services Ltd. but manufactured by a third party, the benefit of the manufacturer's warranty will be passed on to the customer where possible.
5.3. The guarantee excludes:
Damage caused by misuse, neglect, accident, or third-party interference;
Work carried out by others following our installation without our consent;
Consumables and components subject to natural wear and tear (e.g. lamps, fuses, batteries).
6. Limitation of liability
6.1. James Duffield Electrical Services Ltd. shall not be liable for any consequential or indirect loss suffered by the customer, including loss of profit, business interruption, or loss of data.
6.2. James Duffield Electrical Services Ltd. shall not be liable for delays beyond our control, including delays caused by suppliers, utility companies, or unforeseen site conditions.
6.3. Liability for any claim arising out of or in connection with the works shall be limited to the value of the contract or the amount actually received by James Duffield Electrical Services Ltd. under its insurance policy, whichever is lower.
6.4. Nothing in these conditions limits liability for death or personal injury resulting from negligence, or for fraud or fraudulent misrepresentation.
7. Standards and insurance
7.1. All work will be carried out in accordance with the latest edition of BS7671 (IET Wiring Regulations) and other applicable statutory requirements.
7.2. James Duffield Electrical Services Ltd. holds current Public Liability Insurance and will provide evidence on request.
8. Governing Law
8.1. This Agreement shall be governed by and construed in accordance with the law of Scotland, and the parties submit to the non-exclusive jurisdiction of the Scottish Courts.
